TERMS OF USE - GFS WEBSITE

1. PURPOSE OF THE TERMS OF USE

The purpose of these Terms of Use is to provide a legal framework for the terms and conditions of use of the Global Freightage Services LTD (GFS) site and services and to define the conditions of access to and use of the services by the "User".

Any User who accesses the website and Services offered by the GFS undertakes to comply, without reservation, with these Terms of Use. GFS reserves the right to unilaterally modify the content of these Terms of Use at any time.

2. LEGAL NOTICE

The www.globalfreightageservices.com website is published by GLOBAL FREIGHTAGE SERVICES LTD, registered with the RC/DLA/2013/B/2015 and with Taxpayer Number M041300045769Z. The head office is located at Boulevard de la République Bali; Boite postale 15729 - Douala CAMEROUN; Mail : info@globalfreightageservices.com ; Tel : (+237) 243 708 988 / 679 90 65 62.

3. GFS SITE USER INFORMATION

The User declares that he/she has read the information available on the Site (www.globalfreightageservices.com) concerning the essential characteristics of the Services.

4. ACCESS TO THE SITE

The Site is accessible free of charge to any User with Internet access. Non-registered Users do not have access to specific services.

5. EQUIPMENT AND CONNECTIONS REQUIRED TO USE THE GFS WEBSITE

The User is hereby informed that access to the website requires a computer equipped with a browser and an Internet connection, which the User acknowledges he/she already has. 

6. REQUEST OF QUOTATION

To receive a quotation, the User must fill in a form and provide predefined information. Once their request has been validated, a quotation will be sent to them by e-mail.

7. NEWSLETTER

Newsletters are sent to registered Users. To do so, they must provide certain information and validate their registration. Users may unsubscribe by clicking on the appropriate link in the newsletter e-mail.

8. USE OF LOGINS AND PASSWORD

Users acknowledge that they are entirely responsible for the safekeeping and confidentiality of their login details and passwords. In the event of fraudulent use of their identification data (login and password), all Users undertake to inform GFS in writing or by electronic means as soon as possible.

9. PROTECTION OF PERSONAL DATA

In accordance with Law No. 2010/012 of 21 December 2010 on cybersecurity and cybercrime in Cameroon, GFS takes measures to protect personal data. Documents and information provided by Users are confidential. These documents and information are kept by GFS and will only be communicated to its partners if necessary.

10. DIALOG INTERFACE

In accordance with Article 6 paragraph 2 of Decree No. 2011/1521/PM of 15 June 2011 setting the terms of application of Law No. 2010/021 of 21 December 2010 governing electronic commerce in Cameroon, a service has been set up to allow the User to dialogue with GFS. The Contact page allows visitors to the platform to contact us in case of need or misunderstanding. It allows them to formulate requests via a form and contains information or addresses to contact GFS.

11. INTELLECTUAL PROPERTY

The GFS site and all the elements that make it up are, unless otherwise stated, the exclusive property of Global Freightage Services LTD. All trademarks and logos belonging to GFS may not be used by the User without the prior written consent of the owner. 

12. RESPONSABILITIES

GFS puts in place the resources necessary for the proper functioning of the Services. GFS takes the necessary measures to maintain the continuity and quality of the Services. Nevertheless, the User acknowledges that use of the Services is at the User's own risk. The Services are provided "as is" and are accessible without any guarantee of availability or regularity. The GFS will endeavour to make the Services accessible 24 hours a day, 7 days a week, except in the event of force majeure or an event beyond the control of the GFS and subject to maintenance periods, possible breakdowns, technical hazards linked to the nature of the Internet network or acts of malice or any damage to the hardware or software of the GFS.

13. LIMITATION OF RESPONSABILITES

The Company may not be held responsible for: For (and the consequences of) the accuracy or inaccuracy of the information and documents provided by Users;  Direct or indirect damage suffered by the User when caused by another User or when caused by force majeure. Users are responsible for keeping their password secret. Any disclosure of the password, in whatever form, is prohibited. The User assumes all risks associated with the use of his/her login and password. The site declines all responsibility. GFS cannot be held responsible for any viruses that may infect the computer or any other computer equipment of the Internet user, following use, access or downloading from this site. The site may not be held liable in the event of force majeure or the unforeseeable and insurmountable act of a third party.

14. COOKIES

Users are informed that when they visit the site, a cookie may be automatically installed on their browser software. Cookies are small files stored temporarily on the hard disk of the User's computer by your browser and which are necessary for the use of the GFS site. Cookies do not contain any personal information and cannot be used to identify anyone. A cookie contains a unique identifier that is randomly generated and therefore anonymous. Some cookies expire at the end of the User's visit, others remain. In the absence of acceptance, the User is informed that certain functions or pages may be refused. The User may deactivate this cookie using the settings in their browser software. 

15. HYPERTEXTS LINKS

GFS is only responsible for the hypertext links that it creates and exercises no control over External Sites and external sources (third-party sites or mobile applications, social networks, etc.) to which the hypertext links accessible on the Service that the Company has not created redirect. The Company cannot be held responsible for the provision of links to External Sites and cannot accept any liability for their content, advertising, products, services or any other element available on or from these External Sites.

16. APPLICABLE LAW AND JURISDICTION

Cameroonian law applies to this contract. In the event of failure to resolve a dispute between the parties amicably, the Cameroonian courts shall have sole jurisdiction.

The purpose of this Personal Data Protection Policy is to define the principles and guidelines implemented by Global Freightage Services LTD with regard to the processing of the personal data of the Users of its services. 4. PURPOSE OF THE DATA

The purpose of collecting the various data is to ensure the security of the GFS site and to comply with the regulations in force.

The personal data we collect is primarily intended for GFS. However, it may also be communicated to our hosting services and to potential partners.

Personal data is stored either in GFS databases or in those of service providers with whom GFS establishes a dedicated contractual relationship. In the latter case, the GFS undertakes to take appropriate contractual measures in advance to ensure the security of personal data.

7. DATA RETENTION PERIOD

The GFS undertakes to keep personal data in a secure environment for as long as is necessary to achieve the purposes for which it was collected or for the minimum retention period provided for by applicable legislation, particularly with regard to e-commerce or cybersecurity. Certain personal data may be kept by GFS for longer periods exclusively for archival purposes, in the public interest, or for statistical purposes.

8. RIGHT RELATING TO PERSONNAL DATA

The User may ask GFS to update, rectify or delete any inaccurate, outdated or incorrect personal data that it holds. The User also has the right to limit the processing and portability of his/her data.

9. CONFIDENTIALITY

GFS undertakes to: - Keep strictly confidential and not divulge or communicate to third parties, by any means whatsoever, the information sent to it by Users. - Take all necessary measures to preserve the confidential nature of the information. These measures may not be less than those taken by the company to protect its own confidential information. - To communicate the said information only to those members of its staff who are required to read and use it. However, it may communicate the information to partners involved in the provision of services. - To take all necessary steps to ensure that its employees and partners treat such information in accordance with the confidentiality provisions of this policy.

10. IT SECURITY

GFS is committed to keeping the personal data it processes secure. To this end, GFS implements all appropriate technical and organizational measures, in light of the nature, scope and context of the personal data communicated and the risks presented by their processing, to preserve the security of personal data and, in particular, to prevent any accidental or unlawful destruction, loss, alteration, disclosure, intrusion or unauthorized access to such data. Users are also reminded that they contribute to the protection of their personal data by complying with good practice in the use of IT tools.

11. DATA BREACH

In the event that GFS becomes aware that a third party to whom it has disclosed personal data for the purposes set out above is using or disclosing personal data in breach of this Policy or in violation of applicable law, GFS will take steps to immediately stop such use.
